SPECIAL CONDITIONS Futures Sale of 2011 Vintage Wines

Availability : offers are not binding and quantities available are subject to reduction by reason of ongoing sales. There is a heavy demand for this type of sale, so we do our utmost to provide you with regularly updated lists reflecting the latest information available from the chateaux. However, we cannot guarantee to supply the quantities you require and cannot be held responsible if this is not possible.

PAYMENT

Futures must be paid for when you place your order.

ORDERS FOR FUTURES PAID FOR BY CREDIT CARD RECEIVE PRIORITY PROCESSING

  • Visa or Mastercard payment via remote terminal
    (NB : We reserve the right to refuse this method of payment, depending on the amount or place of delivery)
    In certain cases and to avoid fraudulent use of remote payment facilities, our bank may insist that we request a photocopy of both sides of your credit card as well as a copy of your passport or identity card to verify information supplied
  • Swift bank draft (wire) drawn in Euros
  • Postal order in Euros
  • Cheque drawn in Euros on a French bank

We reserve the right to cancel any order for which payment has not reached us within 3 working days from the date of order.

Transfer of ownership
For sales of Futures, the PRO FORMA invoice sent by the Vendor acts also as a “reservation certificate”, and the order is considered firm, with no option to cancel. However, transfer of ownership of the wines does not take place until they are delivered.

TRANSPORT

For wines bought as FUTURES, all prices are stated exclusive of tax and ex-warehouse from our carrier’s premises (33500 Libourne) or from our store in Saint-Emilion. We can arrange to have wines sent to you by ordinary or express road transport or by air anywhere in the world. Just send us a specific enquiry and we will let you have the prices, calculated according to weight, any regulations in force, and final destination.

The Purchaser must notify the Vendor of any change in the delivery address well before the delivery date and if possible before the final invoice is issued.

You can also have your goods collected by a carrier of your choice.

The Purchaser may also collect the goods or arrange for their collection from the Vendor’s cellars : in this case, goods will be released only to the Purchaser or to his/her authorised agent on production of written authority and an identity document.

Bottles are generally packed at source in wooden cases of 6 or 12 bottles, but delivery of wines in wooden cases is not guaranteed.

Wines are transported at Purchaser’s risk. It is essential to check the consignments in front of the deliveryman and, if any damage is discovered, to write any comments on the carrier’s delivery note. You must also advise us within 24 hours so that we can arrange for our carrier to make an insurance claim.

If no one is available to take delivery, the consignment will be left at the place indicated on the delivery note and a copy of this will be put in the letterbox. It will be the Purchaser’s responsibility to collect the consignment within a maximum of 8 working days.

Wines sold as Futures will be kept in our cellars, free of charge, for 60 days after we send our final invoice notifying you of their availability. After that period, our carrier will transfer the wines to a storage facility which will incur charges. For further information, visit : www.depotvins.com

The sender cannot be held responsible for any damage, whatever the circumstances.

DAMAGED OR UNAVAILABLE GOODS

The wines currently offered for sale have been certified by sworn brokers. Nevertheless, only the chateaux are responsible for their own wine production, choice of bottling date and the decision to make the wines available. If, for any reason relating to the quality of the wine, the chateau decides not to sell the vintage in question, the monies paid on account will be reimbursed to the Purchaser in full within 30 days of the said decision ; absolutely no responsibility can be attributed to the Vendor and no interest will be paid.

The Vendor will not be held responsible for any accident leading to destruction of the goods or to significant deterioration in their quality (theft, breakage, fire, etc… in the various places of storage or the various transport vehicles).

In such an event, if no stock is available to supply replacements, the Purchaser will be reimbursed by bank cheque in the amount of the invoice value within a maximum of 30 days after the occurrence.

DUTY FREE

Goods can be purchased duty free if delivered by our carrier and either of the following circumstances apply :

  • Goods are bought by private individuals outside the EU area
  • Goods are bought by companies within the EU with a valid Intracommunity VAT number.

By placing an order the Purchaser is deemed to have read and agreed the Conditions of Sale and Special Conditions.
Only people who are have reached the legal age for the purchase of alcohol in their own country are authorised to order from our site.
